Probably during his review he was tired after climbing over all those bodies.

 So, I'm not surprised he can't see any reason to prosecute Hillary, but can still maintain we'll prosecute, say Scooter Libby and god only knows how many others. Maybe Richard Posner can write another book on how important Hillary is to American leadership; it's another month, so he's got another one due.
